Repeals provisions regarding the Joint Committee on Printing. Transfers responsibilities of the Committee to the Public Printer.
Directs the Public Printer to: (1) remedy neglect, delay, duplication, and waste in public printing and binding and the production of Government publications; (2) prescribe quality standards; (3) utilize requests for proposals and similar authorized purchasing methods where total or partial migration to new technologies is appropriate or when requested by the user; (4) prescribe Government specifications for printing paper and writing paper; (5) assist with the acquisition and transfer of equipment requisitioned by facilities previously authorized and with the disposal of such equipment; and (6) establish policy for the acquisition of printing and Government publications, formulated to maximize competitive procurement from the private sector (but which may provide for use of Government in-house printing and duplicating operations if they provide printing and duplicating at the lowest cost to the Government).
Requires the Public Printer to promulgate rules and regulations for the procurement of printing and Government publications by the Government Printing Office (GPO) not inconsistent with this Act.
Mandates that the annual report to the Congress include a report on: (1) the printing costs of each branch of Government; and (2) a cost comparison of printing and publications as procured through GPO, produced by each Federal agency, produced by commercial sources that are not Federal entities under contract with a Federal agency (other than GPO), and produced by commercial sources that are not Federal entities under contract with GPO.
Directs the Public Printer to establish and maintain the following separate GPO accounts: (1) Superintendent of Documents; (2) Executive and Judicial Print Procurement; and (3) Congressional Services.
Requires that all printing and Government publications for the Congress, the executive office, the judiciary (other than the Supreme Court), and every executive department, agency, independent office and establishment or Government entity be procured from private sector commercial entities by GPO, with exceptions.
Revises provisions regarding: (1) competitive procurement; (2) limits on Government printing production; (3) the use of illustrations; (4) the form and style of work for departments.
Sets forth provisions regarding: (1) departmental distribution of publications; (2) availability, inventory, dissemination, and re-publication of Government publications; (3) projections and reporting on costs for printing by Federal agencies; (4) scoring of sales of assets; (5) "Buy American" requirements; and (6) cost ceilings for certain congressional documents.

A BILL
To improve the dissemination of information and printing procedures of
the Government.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. JOINT COMMITTEE ON PRINTING.
(a) Abolition.--Chapter 1 of title 44, United States Code, is
repealed.
(b) Transfer of Responsibility.--Except as provided in subsection
(c), all duties, authorities, responsibilities, and functions of the
Joint Committee on Printing as of the day before the effective date of
this section shall be performed by the Public Printer on and after such
date.
(c) Oversight Functions.--All legislative oversight jurisdiction,
duties, authorities, responsibilities, and functions of the Joint
Committee on Printing as of the day before the effective date of this
section shall be performed by the Committee on Rules and Administration
of the Senate and the Committee on House Oversight of the House of
Representatives on and after such date.
(d) References.--Reference in any other Federal law, Executive
order, rule, regulation, or delegation of authority, or any document of
or relating to the Joint Committee on Printing shall be deemed to refer
to the Committee on Rules and Administration of the Senate and the
Committee on House Oversight of the House of Representatives, or the
Public Printer, as appropriate.
SEC. 2. PUBLIC PRINTER: APPOINTMENT; DUTIES.
(a) In General.--Section 301 of title 44, United States Code, is
amended--
(1) by amending the section heading to read as follows:
``Sec. 301. Public Printer; appointment; duties'';
(2) by inserting ``(a)'' at the beginning of the first
sentence; and
(3) by adding at the end the following new subsections:
``(b) The Public Printer shall, with respect to the executive,
legislative and judicial branches of the Government--
``(1) use all necessary measures to remedy neglect, delay,
duplication, and waste in the public printing and binding and
the production of Government publications, including the
elimination of internal printing capacities of the Government
Printing Office and the reduction or elimination of internal
printing (including high-speed duplicating) capacities of
executive branch departments, agencies, and entities;
``(2) prescribe quality standards for printing and
publishing of Government publications;
``(3) utilize requests for proposals and similar authorized
purchasing methods where total or partial migration to new
technologies is appropriate, or when requested by the user;
``(4) prescribe Government specifications for printing
paper and writing paper, which shall be consistent with all
environmental and other requirements for such products;
``(5) assist with the acquisition and transfer of equipment
requisitioned by facilities previously authorized under section
501 of this title;
``(6) assist with the disposal of such equipment pursuant
to section 312 of this title; and
``(7) establish policy for the acquisition of printing and
Government publications, which shall be formulated to maximize
competitive procurement from the private sector.
``(c) The policy under subsection (b)(7) may provide for use of
Government in-house printing and duplicating operations, subject to
section 504 of this title, if they provide printing and duplicating at
the lowest cost to the Government, taking into consideration the total
expense of production, materials, labor, equipment, and general and
administrative expense, including all levels of overhead.
``(d) The Public Printer shall promulgate rules and regulations for
the procurement of printing and Government publications by the
Government Printing Office not inconsistent with this Act.''.
(b) Clerical Amendment.--The table of sections for chapter 3 of
title 44, United States Code, is amended by striking out the item
relating to section 301 and inserting in lieu thereof the following new
item:
``301. Public Printer; appointment; duties.''.
SEC. 3. ANNUAL REPORT TO CONGRESS.
Section 309(c) of title 44, United States Code, is amended--
(1) by inserting ``(1)'' after ``(c)''; and
(2) by adding at the end the following new paragraph:
``(2) The annual program submitted under this subsection shall
include a report on--
``(A) the printing costs of each branch of the Government;
and
``(B) with regard to Government printing and publications,
a cost comparison of--
``(i) printing and publications procured through
the Government Printing Office;
``(ii) printing and publications produced by each
Federal agency;
``(iii) printing and publications that are produced
by commercial sources that are not Federal entities
under any contract with a Federal agency (other than
the Government Printing Office); and
``(iv) printing and publications that are produced
by commercial sources that are not Federal entities
under any contract with the Government Printing
Office.''.
SEC. 4. DEFINITIONS.
(a) In General.--Chapter 3 of title 44, United States Code, is
amended by adding at the end the following new section:
``Sec. 318. Definitions
``As used in this title--
``(1) the term `Government publication' means any
informational matter that is published at Government expense,
or required by law;
``(2) the term `publish' means, with respect to
informational matter, make available for dissemination; and
``(3) the term `printing' includes the processes of
platemaking, presswork, ink jet, electrostatic or other copying
or duplicating, laser or variable imaging, silk screen
processes, production of an image on paper or substrate by any
means or equipment (including printed forms, printing required
as part of a contract for other supplies or services and all
printing items whether for internal use or public
dissemination), binding, microform, or the end items of such
processes, except that such term does not include desktop
composition and the production of camera ready copy or
electronic media to be used in the printing process.''.
(b) Technical and Conforming Amendments.--
(1) The table of sections for chapter 3 of title 44, United
States Code, is amended by adding at the end the following new
item:
``318. Definitions.''.
(2) Section 1901 of title 44, United States Code, is
amended by striking out ``as an individual document''.
SEC. 5. GOVERNMENT PRINTING OFFICE ACCOUNTS.
(a) In General.--Chapter 3 of title 44, United States Code, as
amended by section 4, is further amended by adding at the end the
following new section:
``Sec. 319. Government Printing Office accounts
``The Public Printer shall establish and maintain the following
separate and distinct Government Printing Office accounts: (1)
Superintendent of Documents; (2) Executive and Judicial Print
Procurement; (3) Congressional Services.''.
(b) Clerical Amendment.--The table of sections for chapter 3 of
title 44, United States Code, as amended by section 4, is further
amended by adding at the end the following new item:
``319. Government Printing Office accounts.''.
SEC. 6. PROCUREMENT OF PRINTING AND GOVERNMENT PUBLICATIONS BY THE
GOVERNMENT PRINTING OFFICE.
(a) In General.--Section 501 of title 44, United States Code, is
amended to read as follows:
``Sec. 501. Government printing and Government publications to be
procured by the Government Printing Office
``(a) All printing and Government publications for Congress, the
Executive Office, the Judiciary, other than the Supreme Court of the
United States, and every executive department, agency, independent
office and establishment or entity of the Government, shall be procured
from private sector commercial entities by the Government Printing
Office, except--
``(1) printing in field printing plants subject to section
504 of this title;
``(2) procurement of printing or Government publications,
if approved by written waiver issued by the Public Printer
certifying that such direct procurement is more economical than
procurement through the Government Printing Office;
``(3) procurement of individual printing or Government
publication orders costing not more than $1,000, if such orders
are not of a continuing or repetitive nature and, as certified
by the Public Printer, are included in a class of work which
cannot be provided more economically by open, competitive
procurement through the Government Printing Office;
``(4) printing for the Central Intelligence Agency, the
Defense Intelligence Agency, and the National Security Agency,
and printing of documents classified secret by the Department
of Defense; and
``(5) production of printing or Government publications
from other sources that is specifically authorized by law.
``(b) Any Federal officer or employee who publishes a Government
publication or orders or contracts for an individual printing order
under paragraphs (1), (2), and (3) of subsection (a) shall include as a
term of any order or contract for such publication or printing that the
executive agency or department, or the commercial source that provides
the publication or printing shall deliver to the Superintendent of
Documents, in the form and manner prescribed by the Superintendent, a
sufficient quantity of the product produced under such order or
contract for inclusion in the depository library program under chapter
19 of this title. The Public Printer shall promulgate regulations to
define the term `sufficient quantity' for purposes of this subsection.
``(c) Printing and Government publications shall not be produced by
the Government Printing Office for Congress, the Executive Office, the
Judiciary, or any executive department, agency, independent office and
establishment of the Government, except that the Government Printing
Office may produce printing necessary to be produced internally to meet
its own needs, subject to the same production limitation placed on the
executive branch by section 504(b)(1) of this title.
``(d) All directives to the Public Printer or the Government
Printing Office, under this title or other applicable laws, as in
effect on the day before the effective date of this section, to print
or to produce printing or binding shall, on and after that effective
date, constitute directives to procure such printing or binding, under
the requirements of this Act.''.
(b) Revocation of Charters.--All printing plant charters authorized
by the Joint Committee on Printing under section 501 of title 44,
United States Code, are revoked.
(c) Technical and Conforming Amendments.--
(1) The item relating to section 501 in the table of
sections for chapter 5 of title 44, United States Code, is
amended to read as follows:
``501. Government printing and Government publications to be procured
by the Government Printing Office.''.
(2) Section 207 of the Legislative Branch Appropriations
Act, 1993 (44 U.S.C. 501 note) is repealed.
SEC. 7. COMPETITIVE PRINT PROCUREMENT.
(a) In General.--Section 502 of title 44, United States Code, is
amended to read as follows:
``Sec. 502. Requirement for competitive procurement
``(a)(1) All printing and Government publications procured or
purchased by Congress, the Executive Office, the Judiciary other than
the Supreme Court of the United States, and every executive department,
agency, independent office and establishment or entity of the
Government shall be procured or purchased with open competition in
compliance with the requirements of paragraphs (2) through (4). For
printing orders and Government publications obtained by the executive
and judicial branches through the Government Printing Office,
compliance by the Government Printing Office with the provisions of
this subsection (a) shall relieve the executive or judicial agency or
entity from the requirements of this subsection (a), but only for those
printing orders and Government publications obtained through the
Government Printing Office.
``(2) All printing and Government publication procurements or
purchases and amendments thereto, shall be publicly displayed in the
issuing office and on an on-line electronic commerce system for not
less than 4 hours prior to the time bids or quotations are due. Shorter
posting periods may only be used to meet emergency requirements.
``(3) As soon as practicable after the time by which quotations or
bids must be received, the issuing office shall compile a schedule of
quotation or bid results containing the solicitation number, and the
name, quotation or bid price and any offered discount of each
responding vendor. As soon as practicable after the award of any
contract for printing or Government publications, the issuing office
shall compile an award schedule containing the solicitation number, and
the name, quotation or bid price and any offered discount of the
winning vendor. The information required to be compiled under this
subsection shall be publicly displayed in the issuing office and on an
on-line electronic commerce system for a period of not less than 24
hours.
``(4) The procuring authority may impose reasonable vendor
registration requirements not in violation of other applicable law. All
responsive quotations or bids from private sector vendors shall be
accepted and considered. Contracts shall be awarded to the responsible
vendor with low quotation or bid.''.
(b) Clerical Amendment.--The item relating to section 502 in the
table of sections for chapter 5 of title 44, United States Code, is
amended to read as follows:
``502. Requirement for competitive procurement.''.
SEC. 8. LIMITATION ON GOVERNMENT PRINTING PRODUCTION.
(a) In General.--Section 504 of title 44, United States Code, is
amended to read as follows:
``Sec. 504. Limitation on Government printing production
``(a) The production of printing by Congress, the Executive Office,
the Judiciary, other than the Supreme Court of the United States and
every executive department, agency, independent office and
establishment or entity of the Government shall be limited as set forth
in subsections (b) and (c).
``(b)(1) No printing or duplicating facility or operation shall
produce any printing or duplicating order for an individual product
which exceeds: 4,000 printing units for a single sheet document; or
20,000 printing units for a multi-paged document. A ``printing unit''
shall equal one (1) one-sided copy of a single 8\1/2\'' by 11'' sheet,
or 93.5 square inches of paper or printing substrate.
``(2) Paragraph (1) shall not apply to printing produced by the
Central Intelligence Agency, the Defense Intelligence Agency, or the
National Security Agency, printing of documents classified secret by
the Department of Defense, or to other printing production specifically
authorized by law.
``(c) The Government Printing Office printing production shall
terminate, pursuant to the requirements of Section 501(c) of this
title, except for printing necessary to be produced internally to meet
its own needs, which shall be subject to the same production
limitations imposed by subsection (b)(1).''.
(b) Clerical Amendment.--The item relating to section 504 in the
table of sections for chapter 5 of title 44, United States Code, is
amended to read as follows:
``504. Limitation on Government printing production.''.
SEC. 9. USE OF ILLUSTRATIONS.
(a) In General.--Section 1104 of title 44, United States Code, is
amended to read as follows:
``Sec. 1104. Use of illustrations
``Appropriations made for printing and binding may not be used for
an illustration, engraving or photograph in a document or report
printed for Congress, the executive branch or the Judiciary unless
specified by the order for printing or copy furnished.''.
(b) Clerical Amendment.--The item relating to section 1104 in the
table of sections for chapter 11 of title 44, United States Code, is
amended to read as follows:
``1104. Use of illustrations.''.
SEC. 10. FORM AND STYLE OF WORK FOR DEPARTMENTS.
Section 1105 of title 44, United States Code, is amended by
striking out ``determine'' and inserting in lieu thereof ``provide
advice and assistance regarding''.
SEC. 11. DEPARTMENTAL DISTRIBUTION OF PUBLICATIONS.
Section 1722 of title 44, United States Code is amended--
(1) by inserting ``(a)'' at the beginning of the first
sentence; and
(2) by adding at the end the following new subsection:
``(b) If a department, agency, or other entity of the Government
publishes a Government publication, the head of the department, agency,
or entity shall furnish the Government publication to the
Superintendent of Documents not later than the date of release of the
material to the public.''.
SEC. 12. AVAILABILITY, INVENTORY, DISSEMINATION AND REPUBLICATION OF
GOVERNMENT PUBLICATIONS
(a) In General.--Chapter 17 of title 44, United States Code is
amended by adding at the end the following new sections:
``Sec. 1723. Government publications to be available throughout the
Government
``All Government publications shall be available throughout the
Government to any department, agency, or entity of the Government for
use or redissemination.
``Sec. 1724. Inventory of Government publications
``Each department, agency, and other entity of the Government
shall--
``(1) establish and maintain a comprehensive inventory of
its Government publications; and
``(2) make such inventory available through the electronic
directory under chapter 41 of this title.
``Sec. 1725. Other dissemination or republication
``(a) In addition to any other dissemination provided for by law,
the Superintendent of Documents shall disseminate or republish
Government publications, if, as determined by the Superintendent, the
dissemination by the department, agency, or entity of the Government is
inadequate. The Superintendent shall have authority to carry out the
preceding sentence by appropriate means, including the dissemination
and republication of Government publications furnished under section
1722(b) of this title, with the cost of dissemination and republication
to be borne by the department, agency, or entity involved.
``(b) The cost charged to the public by the Superintendent of
Documents under subsection (a) for any Government publication (whether
such Government publication is made available to the public by a
department, agency, or entity of the Government, or by the
Superintendent of Documents) may include the cost of republication and
dissemination, but may not include any profit.''.
(b) Clerical Amendment.--The table of sections for chapter 17 of
title 44, United States Code, is amended by adding at the end the
following new items:
``1723. Government publications to be available throughout the
Government.
``1724. Inventory of Government publications.
``1725. Other dissemination or republication.''.
SEC. 13. REPORT ON COSTS FOR PRINTING BY FEDERAL AGENCIES OTHER THAN
THE GOVERNMENT PRINTING OFFICE.
(a) In General.--Chapter 11 of title 44, United States Code, is
amended by adding at the end the following new section:
``Sec. 1124. Projections and report on costs for printing by Federal
agencies
``(a) Not later than 30 days after the end of each fiscal year, the
head of each Federal department and agency shall submit a report to the
Public Printer of the cost of all printing and Government publications
that were published by such agency during that fiscal year. Such costs
shall separately include: (1) Government publications and printing
procured through the Government Printing Office under a Government
Printing Office contract with a commercial source that is not a Federal
entity; (2) Government publications and printing produced by a Federal
entity; and (3) Government publications and printing produced by a
department or agency contract with a commercial source that is not a
Federal entity.
``(b) At the time of budget submission for each fiscal year
commencing in 1995, each department and agency shall submit a report of
planned printing and publishing activity for the coming year to the
Office of Management and Budget, which report shall include the
following: the name of the publication; the mission served by the
publication; estimated design cost; estimated cost of printing;
estimated cost of dissemination, by other than electronic means;
estimated cost of dissemination by electronic means.''.
(b) Clerical Amendment.--
The table of sections for chapter 11 of title 44, United
States Code, is amended by adding at the end the following new
item:
``1124. Projections and report on costs for printing by Federal
agencies.''.
SEC. 14. SCORING OF SALES OF ASSETS.
Notwithstanding any other provision of law, amounts realized from
the sale of an asset by the United States pursuant to this Act or any
amendment made by this Act shall be scored with respect to the level of
budget authority, outlays, and revenues in the fiscal year in which
that asset is sold for purposes of the Congressional Budget Act of 1974
and the Balanced Budget and Emergency Deficit Control Act of 1985.
SEC. 15. BUY AMERICAN REQUIREMENT.
Contracts for the procurement of goods or services related to
printing for the Government may be awarded under title 44, United
States Code, or any other law only to--
(1) individuals who are citizens of the United States; and
(2) other entities which are owned and controlled only by
individuals who are citizens of the United States.
SEC. 16. COST CEILING FOR CERTAIN HOUSE OF REPRESENTATIVES AND SENATE
DOCUMENTS.
Any measure authorizing the printing and production of a House
Document or a Senate Document that is in the nature of a tribute or
memorial shall provide for the maximum production and printing cost of
the document.
SEC. 17. TECHNICAL AND CONFORMING AMENDMENTS IN ORDER OF APPEARANCE IN
UNITED STATES CODE.
(a) Title 1 Amendments.--(1) Section 107 of title 1, United States
Code, is amended by striking out ``Joint Committee on Printing'' and
inserting in lieu thereof ``Public Printer in consultation with the
Secretary of the Senate and the Clerk of the House of
Representatives''.
(2) Section 208 of title 1, United States Code, is amended by
striking out ``Joint Committee on Printing'' and inserting in lieu
thereof ``Public Printer''.
(b) Title 2 Amendments.--(1) Section 4 of the joint resolution
entitled ``Joint resolution to provide for the printing and
distribution of the Precedents of the House of Representatives compiled
and prepared by Lewis Deschler'', approved October 18, 1976 (2 U.S.C.
28e) is amended--
(A) in subsection (a), by striking out ``Joint Committee on
Printing'' and inserting in lieu thereof ``Committee on Rules
and Administration of the Senate and the Committee on House
Oversight of the House of Representatives''; and
(B) in subsection (b), by striking out ``Joint Committee on
Printing'' and inserting in lieu thereof ``Committee on Rules
and Administration of the Senate and the Committee on House
Oversight of the House of Representatives''.
(2) Section 3 of the Joint Resolution of December 24, 1970 (2
U.S.C. 168b) is amended by striking out ``Joint Committee on Printing''
and inserting in lieu thereof ``Committee on Rules and Administration
of the House of Representatives''.
(c) Title 4 Amendment.--Section 145 of title 4, United States Code,
is amended by striking out ``Joint Committee on Printing'' and
inserting in lieu thereof ``Committee on Rules and Administration of
the Senate and the Committee on House Oversight of the House of
Representatives''.
(d) Title 16 Amendment.--Section 312 of the Federal Water Power Act
(16 U.S.C. 825k) is amended by striking out ``Joint Committee on
Printing'' each place it appears and inserting in lieu thereof ``Public
Printer''.
(e) Title 20 Amendments.--(1) Section 5(c) of the National
Foundation on the Arts and the Humanities Act of 1965 (20 U.S.C.
954(c)) is amended by striking out ``Joint Committee on Printing of the
Congress'' and inserting in lieu thereof ``Public Printer''.
(2) Section 7(c) of the National Foundation on the Arts and the
Humanities Act of 1965 (20 U.S.C. 956(c)) is amended by striking out
``Joint Committee on Printing'' and inserting in lieu thereof ``Public
Printer''.
(f) Title 28 Amendment.--Section 411(a) of title 28, United States
Code, is amended by striking out ``Joint Committee on Printing'' and
inserting in lieu thereof ``Public Printer''.
(g) Title 40 Amendments.--Section 602 of the Federal Property and
Administrative Services Act of 1949 (40 U.S.C. 474) is amended--
(1) by striking out paragraph (18); and
(2) by redesignating paragraphs (19) through (21) as
paragraphs (18) through (20), respectively.
(h) Title 44 Amendments.--(1) The table of chapters for title 44,
United States Code, is amended by striking out the item relating to
chapter 1.
(2) Section 305(a) of title 44, United States Code, is amended--
(A) in the fourth sentence, by striking out ``Joint

SEC. 18. EFFECTIVE DATE.
Except as specifically provided in this Act, this Act and the
amendments made by this Act shall take effect on the first day of the
9th month after the month in which this Act is enacted.
