A BILL
To amend title XVIII of the Social Security Act to increase Medicare
payment to skilled nursing facilities that have a significant
proportion of residents with AIDS.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``AIDS Skilled Nursing Care Assistance
Act of 1999''.
SEC. 2. MEDICARE PAYMENT TO SKILLED NURSING FACILITIES WITH A
SIGNIFICANT PROPORTION OF RESIDENTS WITH AIDS.
(a) In General.--Section 1888(e) of the Social Security Act (42
U.S.C. 1395yy(e)) is amended--
(1) in paragraph (1), by striking ``subject to paragraph
(7)'' and inserting ``subject to paragraphs (7) and (11)''; and
(2) by adding at the end the following new paragraph:
``(11) Payment rule for certain facilities.--
``(A) In general.--In the case of a qualified acute
skilled nursing facility described in subparagraph (B),
the amount of payment made to such facility for all
costs of covered skilled nursing services for each day
of such services furnished is equal to the greater of--
``(i) the sum of--
``(I) 50 percent of the facility-
specific per diem rate (computed under
paragraph (3)), and
``(II) 50 percent of the adjusted
Federal per diem rate (determined under
paragraph (4)), or
``(ii) the adjusted Federal per diem rate
applicable to the facility.
``(B) Facility described.--For purposes of
subparagraph (A), a qualified acute skilled nursing
facility is a facility that demonstrates to the
Secretary that for services furnished during a cost
reporting period in a fiscal year, on the basis of the
cost report submitted by the facility for the cost
reporting period of the previous fiscal year, the
percentage of patients entitled to benefits under part
A to whom the facility furnished covered skilled
nursing facility services for the primary diagnosis of
Acquired Immune Deficiency Syndrome (AIDS) during such
cost reporting period of the previous fiscal year is
not less than 35 percent.''.
(b) Effective Date.--The amendments made by subsection (a) shall
apply to payments for services furnished in cost reporting periods
beginning on or after July 1, 1999.
