EPA Fair Play Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to remove the authority of the Environmental Protection Agency (EPA) to prohibit the specification, or restrict the use, of an area as a disposal site for discharges of dredged or fill materials into waters of the United States once the Army Corps of Engineers has issued a permit for the discharge.
Makes this Act effective as of October 18, 1972.

A BILL
To amend the Federal Water Pollution Control Act to clarify and confirm
the authority of the Environmental Protection Agency to deny or
restrict the use of defined areas as disposal sites for the discharge
of dredged or fill material.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``EPA Fair Play Act''.
SEC. 2. PERMITS FOR DREDGED OR FILL MATERIAL.
(a) In General.--Section 404(c) of the Federal Water Pollution
Control Act (33 U.S.C. 1344(c)) is amended in the first sentence by
striking ``The Administrator'' and inserting ``Until such time as a
permit under this section has been issued by the Secretary, the
Administrator''.
(b) Effective Date.--The amendment made by subsection (a) takes
effect on October 18, 1972.
