Equal Credit Opportunity Act - Provides, under the Consumer Credit Protection Act, that any creditor who fails to comply with the provisions of this Act will be liable for: (1) actual damages; (2) specified amounts in individual and class actions; and (3) reasonable attorney's fees.
Prescribes the factors to be considered in determining the amount of award in any class action.
Provides that a person may not offset any amount for which a creditor is potentially liable against any amount owed to such creditor.
Makes it unlawful for any creditor or card issuer to discriminate on account of sex or marital status against any individual with respect to credit or the terms of such credit.
