Channel Islands National Park and Preserve Act of 1979 - Title I: Channel Islands National Park - Establishes the Channel Islands National Park in the State of California.
Abolishes the Channel Islands National Monument.
Requires the Secretary of the Interior to acquire lands for the park from the State of California only by donation or exchange. Places all Federal property within the park under the administrative jurisdiction of the Secretary. Prohibits the Secretary from acquiring lands by condemnation unless the owner of such lands fails to protect their ecological value. Directs the Secretary to establish visitor-use levels for the park. Requires all Federal agencies to minimize the environmental impact of their activities within the park.
Directs the Secretary to submit a management plan for the park to the Senate Committee on Energy and Natural Resources and the House Committee on Interior and Insular Affairs.
Title II: Channel Islands National Preserve - Establishes a Channel Islands National Preserve in order to protect a biologically rich and diverse area of the California coast.
Directs the Secretary of State to enter into agreements with other nations to protect areas of the preserve which are outside the territorial jurisdiction of the United States.
Requires the issuance of regulations providing civil and criminal penalties for the dumping of wastes within the preserve. Grants the Secretary of the Interior final authority over the licensing of any activities in the preserve.
Directs the Secretary of the Department in which the Coast Guard is operating to supervise all loading or unloading of oil within or near the preserve and to regulate marine vessel traffic in the area. Establishes air quality standards for the area.
Restricts the leasing of tracts for oil and gas exploration and drilling. Requires the Secretary of the Interior to complete a study on oil and gas related activities in the area and to issue regulations governing such activities to reduce their environmental and biological impact.
Requires an oil spill prevention and cleanup plan to be implemented in the area.
Prohibits the construction or expansion of industrial facilities within the preserve.
Establishes penalties and enforcement procedures for violations of regulations issued under this title. Empowers any district court of the United States to issue a restraining order for such violations.
Title III: General Provisions - Grants the owners of any single family residence or agricultural property acquired by the Secretary a right to elect a term of use and occupancy for life or twenty-five years. States such right may be terminated by the Secretary if it is inconsistent with the purposes of this Act. Authorizes the Secretary to lease certain agricultural lands that have been acquired.
Establishes a Channel Islands Citizens Advisory Commission to consult with the Secretary regarding the management and operation of the park and preserve.
