Employee Polygraph Protection Act - Makes it unlawful for any employer to use any lie detector test or examination for pre-employment testing or testing in the course of employment, or to discipline an employee or to refuse to hire a prospective employee who refuses to be tested or who seeks to challenge the test legally.
Requires the Secretary of Labor to prepare, have printed, and distribute notices setting forth this prohibition. Requires employers to post such notices.
Provides for the assessment of civil penalties for violations of this Act. Permits injunctive actions by the Secretary. Allows private civil actions to be brought against an employer who violates this Act.
Exempts from this Act's coverage: (1) Federal, State, and local employees; (2) tests conducted pursuant to the performance of intelligence or counterintelligence functions; (3) Federal Bureau of Investigation contractors; (4) tests conducted pursuant to drug security, drug theft, or drug diversion investigations; (5) private employers who provide security services; (6) public utilities; (7) children's day care centers; and (8) nursing homes.
Requires the test administrator to provide the results of such test to the individual examined, upon request.
